Health opens a new administrative channel to reclaim the full amount for the purchase of face masks

The Health Service of the Balearic Islands has opened a new administrative procedure to claim from the company Soluciones de Gestión y Apoyo a las Empresas, S.L., the full amount of the purchase of masks worth 3.7 million euros. In this sense, the Health Service has resolved to withdraw the procedure that was currently open for partial non-compliance and which claimed 2.6 million euros from the company.

According to the analysis of the file, the Health Service considers that there are sufficient elements to declare the nullity of the act of awarding the contract, hence the need to withdraw the open procedure and initiate a new ex officio review and claim the full 3.7 million euros.

The new administrative route opened by the Health Service for ex officio review to declare the contract with the company Soluciones de Gestión null and void is based on these elements:

Lack of capacity to contract the supply covered by the contract, since the company’s corporate purpose did not include the purchase of the masks.
The company’s lack of financial solvency.
The company’s lack of technical solvency.
The Health Service has already notified the company Soluciones de Gestión of both decisions. In this case, since it is an ex officio review due to nullity, the deadline for this new claim is six months. The company has ten working days to present the allegations it deems appropriate and to access the administrative file.

This new administrative procedure is in addition to the criminal procedure, which remains open. In the next few days, the Health Service, through the Autonomous Community Lawyer’s Office, will justify before the magistrate of the National Court that there are clear and sufficient grounds to appear and claim the full amount of the purchase contract, taking into account the damage suffered by the Government of the Balearic Islands and, therefore, its citizens.
