The Executive Council has approved the demolition order and a fine of 1.4 million euros against the owner and developer of illegal building work at Venta de s’Àguila in the municipality of Sant Joan de Labritja .

The actions carried out by the person responsible for these illegal works are valued at an overall penalty of more than 1,479,630.78 euros, and she is given six months to begin the demolition and restoration of the altered physical legality, and three years to carry them out. In the event that this deadline is not met, the Consell de Eivissa may carry out these works in a subsidiary manner.

The buildings subject to the demolition order are a series of constructions (10 in total) that include two laundry rooms, three guest houses, swimming pool, amphitheatre, paved terrace, pergola and photovoltaic installation. All these works will be carried out without a licence as an extension to an original 1956 house on Protected Rural Land in a Natural Area of Special Interest (SRP-ANEI) and are therefore not permitted.

The Department of Land Management reminds us that in addition to fines and demolition orders for illegalities, offences against land-use planning on protected land can result in prison sentences of up to four years. In many sanctioning proceedings, the proposals for sanctions are also aimed at the builders and collaborators of the works carried out, not only at the promoters and owners, because they have the duty to check that the promoter of the works to be carried out has applied for the required licence.

This sanctioning procedure began in February 2023.

Over the last five years, the Department of Territorial Planning of the Consell de Eivissa has managed to have six illegal constructions demolished and has sent six complaints to the Public Prosecutor’s Office for offences against territorial planning on protected land.
