Citizens’ interest in accessing public information from the Government of the Balearic Islands increases

According to the report on the exercise of the right of access to the information published by the Directorate General of Participation, Transparency and Volunteering of the Government and corresponding to 2021, the number of requests submitted in the last year has increased by 51%.

A detailed report on the exercise of the right of access to public information drawn up by the Vice-Presidency of the Govern through the Directorate General for Participation, Transparency and Volunteering points out that there has been a significant increase in the number of requests submitted, with 460 requests received (not counting the 31 requests for environmental information under Law 27/2006, which are not included in this report), 51.82% more than the 303 of the previous year.

This report also highlights the high response by the different bodies of the Autonomous Community, given that only five were rejected by negative silence, so that 98.91% have been expressly resolved and, of these, 85% have been fully or partially upheld.

Another very positive figure is the average processing time for access requests, which was 24.21 days (when the maximum period is one month), although this is a few tenths of a percentage point higher than last year when it was 23.97 days.

The preferred channel of entry was telematic, accounting for 97.39% of the total, and continuing the upward trend shown in recent years.

As for the profile of the applicants, 27% of the applications were submitted by legal entities. Among natural persons, 57.18% were submitted by men, compared to 42.81% by women. This imbalance has been reduced compared to 2020 when only 36.36% of applications were submitted by women.

In terms of subject matter, there is not much variation compared to 2020. More than half, 66.74%, are concentrated in four main areas: trade, industry, crafts, energy, business or gambling (30.87% of the applications submitted, although 90.14% concern information on gaming machines); civil service examinations, civil service and staff of the Autonomous Community or the authorities (15.65%); COVID-19 (10.65%), and health (9.57%).

In terms of the ministries receiving the most applications, the following data are worth highlighting:

The Department of Energy Transition, Productive Sectors and Democratic Memory has received 31.09% of the total number of applications, the vast majority of which deal with gaming machines.

The Regional Ministry of Health and Consumer Affairs has received 20.87%, many of them related to COVID-19.

The DGPTV, as a filtering unit, has resolved 68 applications (14.78%) in the application of the Delegation Resolution of 17 February 2021, mainly those that cannot be processed by this procedure.

Applications from the Regional Ministry of Education, University and Research, plus applications from the Regional Ministry of Education and Vocational Training (in February 2021 there was a reshuffle of the Government structure) account for 9.13% of the total.

The ministries of Finance and Foreign Affairs (six), Mobility and Housing (eight) and Economic Model, Tourism and Labour (nine) have received the fewest applications.

Apart from the resolutions resolved by the DGPTV by delegation, the efforts of the Regional Ministries of Health and Consumer Affairs and Energy Transition, Productive Sectors and Democratic Memory in resolving their applications within the deadline are noteworthy.

Furthermore, it should be noted that only 2% of the resolutions issued within the scope of the Government of the Balearic Islands have been the subject of complaints to the Commission for Complaints on Access to Public Information (CRAIP) or to the Council for Transparency and Good Governance (CTBG). Of the eleven complaints, only two were fully upheld and two were partially upheld. The rest (three) have been dismissed or shelved. There is one in process, which was submitted to the CTBG once the agreement signed in December 2021 with this body came into force.
