Fourteen illegal tourist rentals have been fined a total of 496,000 euros

The same marketer faces a fine of 80,000 euros for renting out two properties in Sant Francesc de ses Salines.

The Department for Combating Intrusion has decided to impose fourteen sanctions in thirteen cases resolved over the last month: one of 80,000 euros (there are two proposed sanctions in the same case), nine of 40,000 euros, one of 24,000 euros, another of 20,000 euros and one of 12,000 euros, for the commercialisation of illegal tourist properties in the towns of Ibiza, San José, San Antonio and Santa Eulalia.

These fourteen sanctions, totalling 496,000 euros, were issued after the tourist inspection service of the Consell de Eivissa reviewed these properties and found that they were in breach of tourism regulations for advertising, contracting and marketing the properties without having presented the corresponding responsible declaration of commencement of tourist activity or prior notification.

The highest sanction, 80,000 euros, corresponds to two properties advertised by the marketer of two properties in Sant Frances de ses Salines, in the municipality of Sant Josep. Another of the sanctioned rentals was advertised through the Facebook page ‘Nice & Cheap’, where the inspectors of the Consell also act and search for offenders.

All the dwellings described are not susceptible to tourist commercialisation on the island of Eivissa. The advertising of all of them was carried out without having presented a declaration of responsibility for the commencement of the tourist activity, and without being registered in the Island Register of Tourist Companies, Activities and Establishments. The properties were advertised on platforms and social networks with availability calendars, check-in and check-out indications, booking cancellations, and other services.

The Councillor for the Fight against Intrusiveness, Mariano Juan, explained that in recent months “we have been able to see how the forcefulness of the Department when it comes to processing cases and proposals for penalties, as well as the effectiveness in collection, is having an effect and many of the offenders no longer think that this is not the case with them”, He remarked that “all, absolutely all offenders end up paying the fines imposed”, either through the voluntary payment period, forced payment, in which the Treasury intervenes and the procedure continues until the offender is found and the amount of the fine is seized; and, in the event that the offender is a foreigner, as he/she remains a debtor in our country, he/she will no longer be able to operate in Spain, since, as soon as he/she has any type of economic income in the country, the Tax Authorities will detect this and resolve the forced payment of the amount owed.
