The Consell de Mallorca will now impose fines of 80,000 euros for illegal tourist rentals

These types of sanctions range from 40,000 to 400,000 euros and until now were imposed in the lower range.

The penalties that the Consell de Mallorca will impose from now on on on those who rent illegally on the island will be 80,000 euros for each property detected. The range of fines for this issue set by law varies from 40,000 euros in its lowest range, up to 400,000 euros in the maximum, and so far were being imposed in the amount of 40,000 euros.

In this way, the proposed penalties to be imposed from now on those who carry out this activity illegally will be worth 80,000 euros, double what has been done up to now, to dissuade these people from ceasing their activity, and to protect and guarantee the legal security of the entire legal offer in the tourism sector.

In the words of the Councillor for Tourism, José Marcial Rodríguez Díaz, ‘the illegal offer, regardless of the sector in which it operates, is not only a very harmful unfair competition for all those who do things well on our island, which are the vast majority but a terrible problem for coexistence, something we want to fight and eradicate’.
Moreover, along these lines, and based on the Decree of Administrative Simplification recently approved by the Government of the Balearic Islands, the Department of Tourism of the Consell de Mallorca will from now on include the obligation to cease the activity in all cases in which penalties are initiated.
The rights of the sanctioned person remain unchanged, and he or she will be able to present allegations to the proceedings, as has been the case until now. Thus, they will have 7 days to argue about the requirement to cease their activity and the deadline for submitting allegations about the sanction will be 15 days in this case, by the new decree approved by the Govern.
Finally, if in 7 days the allegations are not satisfactory, the Consell de Mallorca’s Department of Tourism will transfer these breaches to the Public Prosecutor’s Office so that they can proceed accordingly.
