The CAIB’s legal counsel will file a contentious administrative appeal against the inactivity of the Spanish Government

The Government of the Balearic Islands, through the Law Office of the Autonomous Community, will file a contentious administrative appeal against the inactivity of the President of the Spanish Government, Pedro Sánchez, who fails to fulfil his obligation to convene the Conference of Presidents.

The Government will take Pedro Sánchez’s failure to meet his obligation to convene the Conference of Presidents to court

Article 2 of the Regulations of the Conference of Presidents specifies that the main purpose of this body is to discuss the broad guidelines of public, sectoral and territorial policies. And on matters of relevant importance for the State of the Autonomous Regions. Likewise, article 4 of the regulations stipulates that this body shall meet at least twice a year and that it shall be convened by the President of the Spanish Government, who shall do so either on his initiative, at the request of the Preparatory Committee, or at the request of 10 presidents of autonomous communities and cities with statutes. In the face of the clarity of the regulations, we are faced with the inaction of the Spanish government. Its president, Pedro Sánchez, systematically fails to fulfil his legal obligation because he has not convened it during the calendar year 2023, nor has he done so this year.

Both the president of the Govern, Marga Prohens, and the presidents of 12 autonomous communities and the 2 autonomous cities have asked Pedro Sánchez through letters (individual and joint) to convene the Conference of Presidents. Marga Prohens sent two letters to Sánchez, the first on 21 November 2023 in which she demanded that the Spanish president fulfil his obligation. Three days later, the president of the Balearic Islands signed a joint letter with the presidents of Andalusia, Aragon, the Canary Islands, Cantabria, Castile and Leon, the Community of Madrid, the Community of Valencia, Extremadura, Galicia, La Rioja, Murcia, Ceuta and Melilla. On 15 January 2024, one month after Sánchez promised to convene the Conference and failed to do so, President Marga Prohens sent a second letter in the hope that this new request would be heeded. Similarly, faced with the lack of response to the joint letter from the different autonomous communities and cities, the presidents sent a new joint letter to Pedro Sánchez on 24 April 2024. Neither of the two letters has been answered.

Faced with this situation of non-compliance with its obligations by the President of the Spanish Government, Pedro Sánchez, the Government of the Balearic Islands has instructed the Law Office of the Autonomous Community to initiate the corresponding legal proceedings against the manifest inactivity of the President of the Spanish Government.
