The decree on the intervention regime for potentially polluting activities is approved

The Consell de Govern has authorised the decree on the system of administrative intervention in activities that could potentially pollute the atmosphere in the Autonomous Community of the Balearic Islands, at the proposal of the Regional Ministry of Enterprise, Employment and Energy.

The regulation aims to regulate the control and prevention of atmospheric emissions from installations in which potentially atmospheric polluting activities are carried out. It also defines the Government of the Balearic Islands’ capacity to intervene in these facilities, under the provisions of Law 34/2007, of 15 November, on air quality and atmospheric protection.

Regarding the actions defined in the regulation, the Government will have the power to authorise and establish conditions for facilities that carry out activities that are potentially polluting the atmosphere. It will have the control and monitoring of these facilities. The decree also defines the capacity for inspection and the exercise of the power to impose penalties.

The decree will apply to all facilities where activities are carried out that may be polluting to the atmosphere and that are included in Annex IV of Law 34/2007. These facilities must be located in the territory of the autonomous community of the Balearic Islands.
