The Public Ethics Commission meets to hear the draft bill of the future Open Government Act

The advisory body has been informed of the start of the prior consultation process for the law, which will address aspects of integrity and good governance.

Today, the Director General for Coordination and Transparency, Helena Rubí, chaired the Public Ethics Commission of the Autonomous Community of the Balearic Islands, the advisory body set up to ensure compliance with the Government’s code of ethics. This is the second meeting of the Commission to be held during this legislature and the first to be chaired by Rubí, who was appointed last May as director general responsible for transparency and good governance.

During the session, Rubí announced that the government had begun the public consultation process to draft a law on open government, integrity and quality of services, which will remain open until 30 September on the Citizen Participation Portal. The views of the three members of the Commission appointed for their expertise are important in this initial phase, as the future law plans to introduce provisions on public ethics and approve a statute for senior officials, among other aspects related to integrity.

The Commission has also addressed the need to analyse whether the code of ethics should be revised, as set out in point 2 of the code, in order to adapt it, if necessary, to the most recent regulations on transparency concerning senior officials and temporary staff, in particular Law 2/2024 of 11 April on the creation of the Register of Transparency and Control of the Assets and Activities of Public Officials of the Balearic Islands.

In addition, it has approved the annual report of the committee corresponding to 2023, as established in point 6.3.2 of the code of ethics. It should be noted that 2023 was marked by institutional changes due to the May elections, a fact that affected the functioning of the Commission, which only met once, before the elections.

The Public Ethics Commission was created by point 6 of the Govern’s code of ethics, approved by the agreement of the Consell de Govern on 13 May 2016 and amended on 29 March 2021. The code establishes a series of ethical rules that show the commitment of the government and its entities to ethics and transparency, beyond legal obligations. All Government officials appointed during this legislature have adhered to it.
