The Government approves a cutting-edge decree on the Administration’s data protection policy

The regulation, unprecedented in the Balearic Islands, has received a favourable report from the Spanish Data Protection Agency.

Decree 44/2024, which creates and regulates the organisational structure of data protection, was also recently approved.

The Consell de Govern has today approved a groundbreaking decree approving the personal data protection policy of the Administration of the Autonomous Community of the Balearic Islands (CAIB). Until now, the CAIB had neither promoted nor implemented the General Data Protection Regulation nor Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights. Now, the CAIB can provide the Government with its personal data protection policy, which will regulate the CAIB’s framework of governance and action in matters of personal data protection and digital rights, at all levels of the autonomous Administration, aware of the importance and sensitivity of the personal data handled by the Administration, in compliance with the principle of proactive responsibility.

This regulation has received a favourable report from the Spanish Data Protection Agency.

At the same time, on 4 October the Government also approved Decree 44/2024, which creates and regulates the organisational structure for the protection of personal data of the CAIB and which will be made up of a data protection commission, a technical committee of personal data protection coordinators, a committee of data controllers for each of the ministries and the personal data protection coordinators of each ministry.

A third decree is expected to be passed shortly to create and regulate the CAIB Administration’s Data Protection Delegation.

In order to implement this policy, the Balearic School of Public Administration (EBAP) has already begun to offer specific training courses. Specifically, a 30-hour training course has already been given to the staff of the legal services and the coordinators of the ministries. Likewise, the EBAP will develop and carry out continuous training programmes and specific training activities aimed at raising awareness and training staff.

The Government of the Balearic Islands currently has two personal data protection web portals, one on the Intranet for CAIB staff and another on the Internet for citizens, in order to offer a quality public service in personal data protection and to enable citizens to exercise their rights.

With the implementation of this policy, the CAIB Administration is promoting the culture of personal data protection.
